The applicant shall bear all responsibility for the use of this video (photographs) material and shall not cause any inconvenience to Kansai Television Co.Ltd.(Kansai TV)
Regarding the use of this video (photo) material, the applicant shall not damage the reputation of Kansai TV, any related parties, or any third parties.
In the event a dispute arises between the applicant and a related party or third party, the applicant will resolve disputes at their own expense and responsibility, without incurring any financial or other burden on Kansai TV.

When using the video (photographs), the applicant is responsible for all necessary rights processing, and any necessary notifications and applications other than rights processing regarding the copyrights, neighboring rights, portrait rights, etc. included in the video (photo) material.(other than rights held by Kansai TV)

The Applicant shall not engage in any of the following acts when using the video (photograph) materials.
(1) Use outside the scope of the purpose of use expressly approved by Kansai TV
(2) Unauthorized reproduction, storage, lending or transfer to a third party, etc.
(3) Modification, including trimming, and processing of materials without the permission of Kansai TV
(4) To use the materials for training of generative AI

In the case that the applicant requests to use the video (photo) materials in various platforms such as broadcasting, distribution, websites, events etc. the applicant shall submit an application for each platform. Once Kansai TV grants a license to use the material, the applicant shall pay a separate fee for each approved platform.

When using this video (photo) material, the applicant must show the credit “©Kansai TV" for the entire duration of the licensed material. If there are any other requests from Kansai TV regarding the display of other credits, the applicant shall comply.

If during the production process, this video (photo) material is copied and saved on a storage device (XDCAM, SSD, HDD, flash memory, DVD, etc.), it must be deleted from the storage device promptly after the approved term. The applicant must not save copies of this video (photo) material.

The applicant shall submit to Kansai TV a copy (DVD etc.) of the finished program or video content using the video (photo) material. If used for print media, the applicant shall submit one (1) sample of the publication.

The applicant shall report to Kansai TV the total duration time (or number of photographs) of video (photo) material used within one week of the start of use. In the event that the applicant does not use any of the video(photo) material, the applicant shall report as such to Kansai TV. The applicant shall pay for processing fees in advance in accordance with the payment deadline and payment method on the invoice issued by Kansai TV.

The applicant acknowledges that the fees for the use of the video (photo) materials shall be determined in accordance with internal regulations of Kansai TV. In addition, once this application has been submitted and Kansai TV has commenced process procedures, in the event of cancellation of use due to the applicant's own reason, a cancellation fee will be charged to the applicant in accordance with Kansai TV regulations.
In the event that Kansai TV determines that matters not stipulated in these terms and conditions, or special conditions arise and requests other arrangements, the applicant shall respect Kansai TV's wishes and comply with such conditions after consulting with Kansai TV.

If the applicant violates these terms of use, or if Kansai TV determines that there is a risk of violating them, the applicant shall immediately comply with Kansai TV’s request to cancel the license.
In the event of a violation of these terms of use, or in the event of loss of the video (photo) materials provided by Kansai TV, the applicant agrees to pay a penalty equivalent to three times the basic fee and usage fee stipulated by Kansai TV.
In addition, in the event that the use of the video (photograph) material causes any other damage to Kansai TV, the applicant agrees to pay for all damages.

These terms shall be governed in accordance with the laws of Japan. These terms and any dispute and / or claim arising under or in connection with these terms shall be governed by and construed in accordance with the law of Japan.
